I HEREBY ASSUME ALL THE RISKS OF PARTICIPATING IN BOXING TRAINING OR COMPETITION (hereinafter program) OR ANY OTHER FORM OF PHYSICAL ACTIVITY offered by Fonteneaux Boxing Academy LLC (FBA), including by way of example and not limitation, any risks that may arise from negligence or carelessness on the part of the person(s) or entities being released, from dangerous or defective equipment or property owned, maintained, or controlled by them, or because of their possible liability without fault. *

I CERTIFY that I am physically fit, have sufficiently prepared (mentally) or trained for participation in the programs, activities or events offered by Fonteneaux Boxing Academy LLC (FBA), and have not been advised to not participate by a qualified medical professional. I certify that there are no health-related reasons or problems which preclude my participation in these programs, classes, activities, or events onsite/ offsite of Fonteneaux Boxing Academy LLC (FBA) premises

I ACKNOWLEDGE that this Injury Waiver and Release of Liability Form will be used by Fonteneaux Boxing Academy LLC (FBA) and its program instructors, and their affiliates, and that it will govern my actions and responsibilities at said classes, programs, activities, or events.

IN CONSIDERARTION of my agreement with Fonteneaux Boxing Academy LLC (FBA), and permitting me to participate in these programs, I hereby take action for myself, my executors, administrators, heirs, next of kin, successors, and assigns as follows: (A) I WAIVER, RELEASE AND DISCHARGE from any and all liability, including but not limited to, liability arising from the negligence or fault of the entities or persons released, for my death, disability, personal injury, property damage, property theft,

(B) I INDEMNIFY, HOLD HARMLESS, AND PROMISE NOT TO SUE the entities or persons mentioned in this paragraph from any and all liabilities or claims made as a result of participation in these programs, activities, or events, whether caused by the negligence of release or otherwise.

I ACKNOWLEDGE that these programs, activities and events may involve a test of a person’s physical and mental limits and may carry with it the potential for death or serious injury. The risks may include, but limited to, those caused by facilities, temperature, condition of participant, equipment, actions of other people including, but not limited to, participants, volunteers, coaches, and lack of hydration.

I HEREBY ACKNOWLEDGE that I am fully required to provide my own medical insurance and that Fonteneaux Boxing Academy LLC (FBA) will not be held financially liable for any expenses incurred for treatment of injuries while participating in indoor and outdoor training, sparring, or weight lifting training.

The injury waiver and release of liability shall be construed broadly to provide a release and waiver to the maximum extent permissible under applicable law.

I CERTIFY THAT I HAVE THOROUGHLY READ THE INJURY WAIVER AND RELEASE OF LIABILITY FORM, AND I FULLY UNDERSTAND ITS CONTENT. I AM AWARE THAT THIS IS A RELEASE OF LIABILITY AND A CONTRACT AND I SIGN OF MY OWN FREE WILL.

BY SIGNING THIS FORM, I UNDERSTAND THAT IF I FAIL TO PICK UP MY CHILD ON TIME, AFTER THREE TIMES MY CHILD WILL BE WITHDRAWN FROM TRAINING. ADDITIONALLY, I UNDERSTAND THAT I WILL NOT BE REFUNDED THE COST OF THE CLASS/TRAINING IF MY CHILD IS REMOVED FROM THE CLASS DUE TO LATE PICK UPS.
